ATD Law in association with Mori Hamada & Matsumoto (“ATD Law”, “we”, “our”, or “us”) respects your privacy and takes its data protection responsibilities seriously. We recognize the importance of the personal data that are entrusted to us, and we are committed to managing, protecting and processing your personal data in accordance with applicable laws and regulations.
ATD Law operates as part of MHM Group. Reference in this Privacy Policy to “MHM Group” is references to Mori Hamada & Matsumoto (partnership), Mori Hamada & Matsumoto LPC, MHM Tax Advisory Services, associated offices in Japan and overseas bases of those entities (including the following: Beijing Office; Shanghai Office; Mori Hamada & Matsumoto Intellectual Property Co., Ltd. (Beijing); Mori Hamada & Matsumoto (Singapore) LLP; Chandler MHM Limited; Myanmar Legal MHM Limited; Mori Hamada & Matsumoto HCMC Branch and Hanoi Branch, and ATD Law).
Reference to “you” or “your” are references to data subjects whose personal data are processed by us and/or MHM Group in regard to the activities you have with us.
This Privacy Policy applies to all personal data collected and processed by ATD Law and/or MHM Group, unless covered by a separate privacy policy of the specific entities of MHM Group. The purpose of this Privacy Policy is to inform you on how we use, disclose, or otherwise process your personal data, as well as the steps we take to protect such information. Therefore, please read this Privacy Policy to understand what information we collect, the purposes as to why we collect it, and your rights with regard to such information.

We will process your personal data based on the appropriate lawful grounds: (i) consent; (ii) to fulfill our contractual obligation (including pre-contractual stage); (iii) to fulfill our legal obligation based on laws and regulations; or (iv) we have legitimate interest. a. providing our legal services, which may include conflict of interest checks, background checks, tax reporting obligations, and managing payment.

In the event that we are required—or it is a necessity—to share your personal data to third parties, we will proceed in accordance with the prevailing laws and regulations.

b. Our networking law firms or other advisors, based on your request, in the event that we need to sub-contract our services to such firms or advisors;
c. Third parties that provide their services to us, such as cloud service providers, payroll service providers, and financial/tax advisors;

e. Other third parties to whom you have instructed us to share, transfer, or otherwise disclose your personal data.
5. Cross-Border Transfer
We will disclose or share your personal data to third parties outside of Indonesia only where it is permitted by applicable laws and regulations. We will comply with all the relevant provisions and use available tools to ensure the protection of your personal data, among others data sharing agreement or data processing agreement which contain standard contractual clause on personal data protection.
6. Data Retention Period
Your personal data will be retained in a form that allows identification as long as it is necessary to achieve the purposes of the processing.
Once such purposes have been achieved, we may delete/destruct your personal data or render such data to be anonymous, except as may be required by applicable laws for us to retain such data. Under the relevant laws and regulations, personal data or documents that may contain personal data must be kept for certain period of time—generally, 5 or 10 years.

We understand and respect the importance of keeping your personal data secure and confidential. We will handle all personal data in an appropriate manner in accordance with applicable laws and regulations in order to prevent any unlawful access, misuse, loss, disclosure, or damage to your personal data.
